Terms of use
Effective date: July 21, 2026
These terms govern your use of the Fixiom mobile application and the fixiom.ai website (together, the "Service"), operated by Fixiom LLC, a Vermont limited liability company ("we," "us"). By installing or using the Service you agree to them. If you don't agree, don't use the Service.
1. What Fixiom is — and isn't
Fixiom is an AI-powered diagnostic assistant for vehicles. It provides information, reasoning, reference lookups, and — with an optional OBD2 adapter — readings from your vehicle. It is an informational tool: it is not a repair facility, does not perform repairs, and its output is not professional advice.
Safety first — read this one even if you read nothing else. Vehicles can injure and kill. You (or the professional you hire) are solely responsible for any inspection, repair, or modification you perform, and for verifying any specification — torque values, capacities, procedures — against the manufacturer's service information before relying on it. Work on safety-critical systems (brakes, steering, airbags/SRS, fuel, high-voltage/hybrid components) requires proper training and equipment; when in doubt, use a qualified professional. Never rely on the Service while driving.
2. AI output can be wrong
Fixiom is engineered to verify what it can and to say so when it can't (see How Fixiom uses AI) — but no AI system is infallible. Answers, diagnoses, specifications, diagrams, and references may be incomplete, outdated, or incorrect. They are starting points for your own judgment, not guarantees. You agree not to treat any output as a substitute for the manufacturer's service information or for a qualified professional's assessment.
3. No account; your anonymous ID
Fixiom doesn't use accounts. Your credits, plan, and purchases attach to a random anonymous identifier created on your device (your "Support ID"). Because there is no account to recover: deleting the app, clearing its data, or switching devices can permanently disconnect that identifier — which forfeits any unused top-up credits and requires using the store's restore-purchases mechanism for subscriptions. Keep that in mind before uninstalling with a balance outstanding.
4. Plans, credits, and billing
- All purchases are made through Apple's App Store or Google Play and are governed by their terms and payment systems. We never receive your payment card details.
- Subscriptions auto-renew until you cancel in your store account settings (App Store: Settings → your name → Subscriptions; Google Play: Payments & subscriptions). Cancelling stops future renewals; it doesn't retroactively refund the current period.
- Credits meter the AI features. Monthly plan credits reset each calendar month and don't roll over. Top-up credits don't expire but are tied to your installation (see section 3). Credit amounts per feature are shown in the app; current plans and prices are at fixiom.ai/pricing.
- Refunds follow the App Store's / Google Play's policies and processes. Where a store refunds a purchase, the corresponding plan benefits or credits are revoked.
- The scan-tool features (code reading/clearing, live data, freeze frames, emissions checks) are free and don't consume credits.
- We may change prices or plan contents prospectively; changes take effect at your next renewal and will be reflected in the app and on the pricing page before they bind you.
5. Fair use of the free tier
Free AI credits exist so you can genuinely evaluate and casually use Fixiom. We may apply technical limits (rate limits, velocity checks, temporary capacity pauses) to keep the free tier available for everyone and to prevent automated or abusive consumption.
6. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to facilitate disabling of emissions controls or safety systems in violation of applicable law;
- probe, scrape, overload, or disrupt the Service, or access it by any automated means;
- attempt to extract, reverse engineer, or misappropriate the Service's software, prompts, models, or data, except where the law grants you that right notwithstanding this term;
- resell, sublicense, or offer the Service to third parties as your own service;
- use the AI features to generate content unrelated to vehicles and their repair (that's not what the metering is priced for, and it's grounds for termination).
7. Your content
You keep whatever rights you have in the content you submit (messages, photos, vehicle data). You grant us the limited license needed to process that content to operate the Service — including processing by the service providers listed in the Privacy policy. You're responsible for having the right to share what you submit.
8. Our property
The Service — its software, design, branding, and content (excluding your content and third-party materials) — belongs to us and our licensors and is protected by intellectual-property law. These terms give you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your own use, subject to these terms and the applicable store's rules.
9. Third-party services and stores
The Service links to and interoperates with third-party services (for example, YouTube searches, diagram sources on the open web, NHTSA data). Those services are theirs, not ours, and their terms govern your use of them. We're not responsible for third-party content, including the accuracy of externally hosted diagrams or videos.
If you downloaded the app from Apple's App Store: these terms are between you and us, not Apple; Apple has no obligation to furnish maintenance or support; Apple is not responsible for any product warranty or for addressing claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these terms with the right to enforce them against you. Equivalent provisions apply for Google Play per Google's developer terms.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL; (b) WE WILL NOT BE LIABLE FOR PROPERTY DAMAGE, PERSONAL INJURY, OR REPAIR OUTCOMES ARISING FROM WORK YOU OR OTHERS PERFORM ON A VEHICLE; AND (c) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF $50 OR THE AMOUNTS YOU PAID US THROUGH THE STORES IN THAT PERIOD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
12. Indemnity
You will defend and hold us harmless from claims arising out of your violation of these terms or your misuse of the Service, to the extent permitted by law.
13. Termination
You can stop using the Service at any time. We may suspend or terminate access (including revoking credits obtained in violation of these terms) for abuse, fraud, or material breach. Sections that by their nature should survive (2, 7–12, 14) survive termination.
14. Governing law; disputes
These terms are governed by the laws of the State of Vermont, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Vermont. Before filing anything, email [email protected] — most issues get fixed faster that way.
15. Changes to these terms
We may update these terms; material changes will be posted here with a new effective date, and where required we'll provide additional notice in the app. Continued use after the effective date constitutes acceptance.
